4. Police Matters. 

 

            Matters from last meeting:-

 

None

 

New Police Matters. 

 

4.a Outside light at Police Station under repair.

4.b Broadford  station is due to close and the present police force will be deployed from Kyle.

4.c Potholes, the police do have a good relationship with the Council / Transerve such that any

major/ dangerous pothole if brought to the attention of the Police, action can be taken to            

      implement  repair.

4.d Dog fouling.  The Dog Fouling (Scotland) Act 2003 came into effect on 22nd

      October 2003, to protect residents from the risk and dangers of abandoned dog faeces.

      The Act states that it is an offence for the person in charge of a dog to leave its mess

      without removing it  Removing the faeces does not mean throwing or depositing them

      onto any other public open space: in other words any place open to the air, which the

      public has access, and any common area such as a close, stair or back green.

      Exceptions and exemptions are if the dog has diarrhoea.  If clearing it          

      up presents a risk of injury to the person in charge or to others.  There are also certain

      people to whom the act does not apply.  These include a blind person, who is in charge of a

      dog that is used for their guidance.  A disabled person with a physical impairment, who is in

      charge of a dog that is trained to assist them with their impairment

      Both the police and authorised local council staff can issue a fixed penalty notice to

      someone  whom they suspect of committing an offence under the Act that is a fixed penalty

      of £40.  If not paid within 28 days this figure is increased to £60.  If the increased fine is

      still not paid, the local council is able to register the unpaid fine as a civil debt and can

      begin debt collection proceedings.

 

      No further Police matters, the two officers left the meeting.

 

5. Kyle Development Group ( KDG) update

 

            Fiona Begg from the KDG was present to give an update on the KDG and forth coming events.

            Fiona commenced with an intro of  the intentions of the KDG with main aim to obtain some

            form of  control over the Plock from the trusties, and KDG involvement with the Scottish

            Community Foundation.  The group will be holding a drop in / consultation  at the Kyle Hotel

between  24th – 26th March to be called Kyle Conversation for members of the public to make comment on Kyle regeneration / development, with the intention of continuing the Kyle Conversation over the next 3 month period.  Discussion followed with regards to comments made by Fiona mainly to do with the Plock Trusties.

 

6. Community Council Reform.

 

Audrey brought it to the attention of the C.C. the forth coming changes to C.C.s with the fact that  Kyle C.C. will be reduced to 7 members.

Since the meeting the new reform has been issued and electronic copies sent to all members.

 

 

 

 

 

7. Dog Fouling on pavements

 

This item has been covered under Police Matters.  Audrey to find out if the street cleaner has a responsibility to clear up any dog fouling.  The subject of bins for the disposal of  dog faeces was discussed and it was mentioned that this can be deposited in green bins only around the village, providing the bag is secure, and in the absence of normal bins for dog waste disposal. If  a C.C. requests further red dog waste bins then it becomes the responsibility of the C.C to arrange for the bins to be emptied.  Since the meeting it has been found out that a request for the Dog Warden to visit Kyle would come from Dingwall but would have to be requested through George Speed,( letter to be sent to G.S.)

 

 

8. Fly tipping Kyle / Plockton Road.

 

The amount of fly tipping has increased in the lay-by coming into Kyle from Plockton.  This land belongs to the NTS,  update since meeting, in conversation with Ian Turnbull NTS he is aware of this and the trust has spent several thousand pounds in clearing this area in the past in particular down the embankment the other side of the layby.

The subject of free skips to the C.C as from the 1st April 2011 being cancelled also came under discussion.  As Kyle does not have a recycling point or access to a community skip location then it was agreed that a letter should be sent to Ann MacDonald bringing to her attention the lack of a suitable recycle point close to Kyle.

           

 

9. Update on refurb of old signal box.

 

Funding is in place but the committee is still waiting on the final decision with regards to the lease before work can commence.  Survey work has been carried out with regards to the top access route.

 

 

10. The way bins once emptied are left in the road/ on footpaths.

 

It was decided that owing to the fact that a good job is being carried by the bin collectors that no comment should be made other than the bin owners should remove their bin from the footpath ASAP once it has been emptied to prevent obstruction of the footpath or road.

           

 

11. Forth coming Ward Forum

 

            Next Ward Forum will be 21st March at 1500hrs Plockton Village Hall.

 

 

12. Future car parking around Kyle

 

Still an ongoing problem with no real way forward.  Mr Mark Crow ( TEC) in Portree is the

new replacement for Mr Tolby who was to report on the parking situation in Kyle.  Letter to be sent for any update to Mr Crow.

 

 

 

 

 

13. Correspondence.

 

Correspondence that had not been brought to the attention of members between the last meeting and this was produced as follows:-

1.      New plans for the development of the Old Surgery Site

2.      Wester Ross Alliance membership form, C.C. decided not to take up the option of the £10 payment to be able to link web sites.

3.      Planning application for the conversion of the Old Post Office.

4.      The end of free allocation of Community Skip as from 1st April 2011 See item above on Fly

Tipping.

5.      Letter from Blue Fin Insurance  Service Ltd, with ref to C.C. and third party cover.  Letter

To be sent to the Region with ref to our third party insurance cover.

14.a Travellers possibly parking in the lay-by into Kyle to be investigated to see if anything to 

        do with the start of rock stabilisation  operations.
